Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Egestion Discord application, its command interface, and the web dashboard available at this site (together, the "Service"). Egestion is operated by the individual or entity identified in section 13 ("we", "us").

You accept these Terms when you do any of the following: add Egestion to a Discord server, sign in to the dashboard with your Discord account, issue a command to the bot, or purchase Premium. If you do not accept them, do not do those things, and remove the bot from any server where you have already added it.

These Terms sit alongside our Privacy Policy, which is incorporated here by reference and explains what data the Service processes.

You must hold a Discord account in good standing and meet Discord's own minimum age requirement for your country. Where you act on behalf of an organisation, you represent that you are authorised to bind it to these Terms.

The Service is layered on top of Discord. Discord's Terms of Service and Community Guidelines apply to you independently of these Terms. Where the two genuinely conflict on something Discord requires of you, Discord's rules prevail : we cannot licence you to break them.

To perform the functions you enable, Egestion requires Discord permissions in your server. Those permissions are granted by you, at invite time and afterwards through Discord's own role and channel settings, and can be narrowed or revoked by you at any moment without our involvement.

Depending on the features you turn on, the bot may: delete messages, time out, kick or ban members, create and modify roles and channels, change channel permissions, read message content in channels it can see, and post in channels you designate. It exercises those powers only according to the configuration held for your server.

Reducing a permission may silently disable a feature that depends on it. That is expected behaviour and not a defect: the bot cannot act beyond what Discord grants it, and it will not attempt to work around a restriction you have set.

Egestion is an instrument you configure; it is not a moderator with independent judgement. Every automatic action it takes (a deletion, a timeout, a ban, a lockdown) follows a threshold, filter or rule that you or someone you authorised set.

Accordingly, you are responsible for:

• the moderation rules you configure and the sanctions they produce, including false positives;
• informing your members, where the law applicable to you requires it, that an automated tool moderates the server and logs certain activity;
• who you delegate dashboard access to, and what those people change;
• the lawfulness of the content and conduct you permit in your server.

Where data protection law applies to your server's activity, you act as the controller of your members' data and we act as a processor on your instructions, as described in the Privacy Policy.

You agree not to use the Service, or encourage anyone else to use it, in order to:

• harass, stalk, dox, or target an individual or a group, including by using the logging features to build a dossier on someone for those purposes;
• evade a Discord enforcement action, or help someone else evade one;
• break any law that applies to you, or facilitate someone else doing so;
• attack, overload, probe, reverse-engineer, or otherwise interfere with the Service's infrastructure, or attempt to reach data belonging to a server you do not administer;
• resell, sublicense, or present the Service as your own product, or operate a derivative service on top of its API;
• automate the dashboard or the API beyond ordinary human use, including scraping and load generation.

The mass-action features (server backup and restore, role synchronisation, permission stripping, raid lockdown) exist to recover from an attack. Using them to disrupt a server (yours or anyone else's) is a breach of these Terms.

We aim for continuous availability and we publish an uptime target, but we do not commit to a service level. The Service depends on Discord's gateway and API, on network transit, and on infrastructure providers, none of which we control. Outages, rate limits imposed by Discord, and scheduled maintenance will occur.

We may add, change, or withdraw features. Where a change removes a capability you rely on, or moves a free capability behind Premium, we will give reasonable advance notice through the dashboard or the support server, except where the change is required for security or legal compliance : in which case it may be immediate.

We may impose reasonable technical limits (rate limits, size caps, quotas) to keep the Service stable for everyone, and adjust them as load requires.

Premium is an optional paid tier applied per Discord server, not per user. It raises limits and unlocks convenience features; the core moderation and anti-raid capabilities remain available without it.

Payments are processed by our payment provider. We never receive or store your card number, and the provider is told only which server the purchase is for and how long it runs. Premium activates once the provider confirms the payment, and expires at the end of the paid period unless renewed.

Premium is sold as a fixed-term entitlement that begins immediately on activation. Because the digital service is supplied in full at that moment and you asked for it to begin, any statutory right of withdrawal is spent at activation. Beyond that, we will refund a period during which Premium was unusable because of a sustained fault on our side; we do not refund an unused remainder because you changed your mind, nor a term that ran while you simply did not use the features.

Gift codes are single-use, transferable until redeemed, tied to a server once applied, and hold no cash value. A code that has been redeemed cannot be reversed or re-issued. Codes issued to you at no cost may be revoked if they were obtained through error, abuse, or a breach of these Terms.

Prices shown include applicable taxes where we are required to state them inclusively. We may change prices for future terms; a price change never affects a term already paid for.

You may end this agreement at any time by removing Egestion from your server. Doing so stops all processing for that server and deletes its stored configuration, infractions and moderation history, as described in the Privacy Policy. Deletion is not reversible and does not by itself refund an active Premium term.

We may suspend or terminate access, to a server, an account, or the Service as a whole, where there is a breach of section 5, where continued operation would expose us or other users to legal or security risk, or where Discord requires it. Where circumstances allow, we will warn first and limit the suspension to what is necessary.

If we terminate your access without a breach on your part, we will refund the unused portion of any Premium term on a pro-rata basis.

The Service (its code, interface, name and marks) belongs to us. These Terms grant you a personal, revocable, non-exclusive, non-transferable right to use the Service as it is offered, and nothing more.

Content you supply through the Service (welcome messages, filter word lists, embed layouts, uploaded imagery, backup archives) remains yours. You grant us the limited licence needed to store, transmit, render and display that content in order to run the features you enabled : nothing broader. We do not use it to train models, and we do not sell it.

You warrant that content you supply does not infringe anyone's rights. If you believe something served through the Service infringes yours, contact us at the address in section 13 with enough detail to locate it.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose and uninterrupted operation. In particular, we do not warrant that automated moderation will catch every prohibited message, that anti-raid will stop every raid, or that a backup will restore a server to an identical state.

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of data, loss of a Discord server or its community, loss of revenue, or loss of goodwill. Our total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the amount you paid us for Premium in the twelve months preceding the event, and (b) €50.

Nothing in these Terms limits liability that cannot lawfully be limited : including liability for death or personal injury caused by negligence, for fraud, or for a consumer's non-excludable statutory rights. If you use the Service as a consumer, those rights stand regardless of anything above.

Because no automated system is perfect, do not rely on Egestion as your only line of defence. Keep human moderators, keep your own backups of anything you could not bear to lose, and keep Discord's native safety settings configured.

The Service is built on Discord and cannot function without it. We are not affiliated with, endorsed by, or sponsored by Discord Inc. "Discord" is their trade mark, used here only to identify the platform.

We rely on a small number of providers to operate: a payment processor for Premium, and hosting and infrastructure providers for the servers and databases. Their availability, failures and terms affect the Service, and we are not responsible for their acts beyond our own choice to use them and our duty to select them with care.

If Discord changes its API, its rate limits, or its policies in a way that makes a feature impossible or unlawful, we may withdraw that feature without it being a breach of these Terms.

We may revise these Terms. Every revision carries a version number and an effective date, both shown at the top of this page, and the previous text is superseded from that date.

For a change that materially reduces your rights or materially increases your obligations, we will give at least 30 days' notice before it takes effect, through the dashboard, the support server, or a message to server administrators. Continuing to use the Service after the effective date means you accept the revised Terms; if you do not accept them, remove the bot before that date. Where such a change lands mid-term on a paid Premium period, the previous Terms continue to govern that period.

Corrections that do not change meaning (typography, broken links, clarified wording) take effect immediately and do not restart the notice period.

These Terms are governed by French law. Disputes fall to the courts of France, save that if you are a consumer resident in the European Union, you keep the right to bring proceedings in the courts of your country of residence and to rely on the mandatory consumer-protection rules that apply there.

Before litigating, please write to us : most disputes about a bot are a misunderstanding about a setting, and are resolved in a message. Consumers in the EU may also use the European Commission's online dispute resolution platform.

If any provision of these Terms is held unenforceable, it is severed and the rest continues in force. Our failure to enforce a provision is not a waiver of it.

While the Service is still in development we do not publish a postal address. Egestion operates anti-raid and anti-DDoS infrastructure, and publishing the operator's address would make that infrastructure (and the servers relying on it) easier to attack. Write to [email protected] for any legal or contractual matter, including formal notice, and we will respond with the identification the matter requires. Nothing in this paragraph limits any right you have under mandatory law.
